General Terms and Conditions of Sale (GTC)
Article 1: Purpose
These GTC govern the contractual relationship between the company operating the W website (hereinafter the "Seller") and any natural or legal person (hereinafter the "Customer") purchasing digital video content on the W website.
Article 2: Products and Services
The Seller offers two types of services:
Sale of Videos from the Catalog:
Professional videos in UHD 4K quality, incorporating visual effects (VFX).
The basic films are produced by the Seller or acquired under a license guaranteeing royalty-free use.
The Customer may request the inclusion of personalized contact information (name, logo, brand, slogan, address, and/or telephone number) for separate and personalized attribution.
The videos are sexy, chic, sensual, non-pornographic, and intended for a major clientele of professionals or individuals.
Custom Video Creation: Complete creation of 4K UHD videos, produced based on the Client's personalized request and specifications.
This service is provided upon prior quotation.
The Client guarantees that they are the author and owner of the files provided, or have full authorization to use them for the creation. The Seller declines all liability in the event of a dispute regarding the rights to client files.
Article 3: Pricing and Payment
The prices of the videos offered for sale on the website www.MySexyVideo.com© are indicated in euros and exclude tax. The prices of custom video creations are set by the quote accepted by the client. Payment terms are specified on the website www.SexyVideoClip.com© for catalog products, and on the quote for custom creations.
Article 4: Order, Proof, and Validation
Purchasing a video on the website: www.MySexyVideo.com© implies full acceptance of these Terms and Conditions, evidenced by the order confirmation. The data recorded by the Seller constitutes proof of all past transactions.
The Customer may view the videos on the website www.MySexyVideo.com© or its watermarked YouTube channel before purchase.
Article 5: Delivery of Digital Products
The ordered product is a digital product.
Upon online purchase and payment confirmation, the video (without watermark and personalized if requested and paid for) is sent to the Customer within 24 hours via digital link (secure download).
Receipt of the video via digital link is considered effective delivery.
Article 6: Intellectual Property and Assignment of Rights
6.1 Sale of Catalog Videos (including customization)
Assignment to the Client: Once the video is sold with the Client's personalized contact information included, the intellectual property rights to the final video (as delivered and customized) are assigned to the buyer.
Seller's Reservation: The basic files (rushes, graphics, licensed music) purchased and used by the website www.MySexyVideo.com© to create the video remain the property of the Seller.
The Seller remains free to use them to create other videos, including for other clients.
6.2 Creation of Custom Videos
The intellectual property rights to the custom-created video are assigned to the Client after full payment for the service, provided that the Client has provided files for which they hold the usage rights.
Article 7: No Right of Withdrawal and Refund
In accordance with Article L221-28 of the French Consumer Code, the supply of digital content not provided on a physical medium, the execution of which has begun after the consumer's express prior consent and express waiver of their right of withdrawal, is not subject to a right of withdrawal.
Refunds are not possible after purchase because this is a digital product delivered via a digital link and the execution of which begins immediately.

Article 8: Liability
Content and Use: The Seller ensures that the content of the videos is sexy, chic, sensual, non-pornographic, and intended for an adult audience. The Seller declines all responsibility for the use, distribution, or modification that the Customer makes of the video after purchase and delivery. Third-Party Rights: For custom-created videos, the Seller shall not be held liable for any violation of intellectual property rights or image rights related to the files and elements provided by the Customer.
Article 9: Applicable Law and Disputes
These General Terms and Conditions are subject to the law of the United States of America in the State of New Mexico. In the event of a dispute, the Customer is invited to contact the Seller to find an amicable solution.
Failing this, and in accordance with the Consumer Code, the Customer has the option of resorting to conventional mediation or any alternative dispute resolution method.
Any dispute not resolved amicably will be brought before the competent courts in USA.
